Compulsory insurance of employee against accidents while fulfilling his/her official (employment) duties
Insurance of employee against accidents while fulfilling his/her official (employment) duties is effected on the basis of the Law of the Republic of Kazakhstan Nr. 30-III ЗКР dated 07.02.2005.
Insured event is the accident occurred with an employee (employees) while fulfilling his/her official (employment) duties as a result of production injury, sudden health deterioration or poisoning of an employee, which led him/her to occupational disability, occupational disease or death.
Sum Insured is established by the agreement, but should not be less than yearly salary fund of all employees at the moment of Agreement conclusion.
Insurance rates are differentiated on types of economic activity depending on the class of professional risk and 3 personnel types (Production, Subsidiary and Administrative) in accordance with the Law.
Insurance indemnity for the harm connected with the death of an employee or injury of his health, shall be executed in the amount of actual harm but not more than the sum insured established by the Agreement.
The amount of harm connected with the loss of earnings (income) in connection with the death of an employee or loss of his ability to work shall be determined in accordance with requirements of Civil Code of the Republic of Kazakhstan.
Insurance indemnity, on reimbursement of expenses caused by the harm to the health of an employee in case of his occupational disability shall be determined by following extents:
1) in case of his occupational disability from 5 till 29 percents inclusive – 500 MCI;
2) in case of his occupational disability from 30 till 59 percents inclusive – 1 000 MCI;
3) in case of his occupational disability from 60 till 89 percents inclusive – 1 500 MCI;
4) in case of his occupational disability from 90 till 100 percents inclusive – 2 000 MCI;
In case of death of the injured employee, the person who has implemented his burial shall be reimbursed for burial expenses by the Insurer in the amount of 100 MCI.
